Our store is hosted by Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our Products and Services to you.

SECTION 1 - ONLINE STORE TERMS

By agreeing to these Terms and Conditions, you represent that you are at least the age of majority in
your state or province of residence, or that you are the age of majority in your state or province of
residence, and you have given us your consent to allow any of your minor dependents to use this site. You may not use our Products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.

SECTION 2 – PACKAGING

Fulcher’s Seafood utilizes dry ice for shipping food Products. If dry ice is used, care must be taken when opening and/or handling the package and its contents. DRY ICE CAN CAUSE BURNS AND OTHER INJURIES. DO NOT HANLDE DRY ICE WITHOUT THE PROPER PROTECTION. You are responsible for the safe handling and disposal of any dry ice included with Products that we ship to you. Always handle dry ice with care and wear protective cloths whenever touching it. You acknowledge that prolonged Dry Ice contact with the skin will cause injury. Fulcher’s Seafood utilizes third party packaging materials. SEE SECTION 10.

SECTION 3: SHIPPING AND DELIVERY

You are responsible for inspecting all Products you receive from us for any damage or other issues upon delivery. In addition, you are solely responsible for determining the freshness of the Products you receive. In the unlikely event that you have any other reason to believe that any Product in your delivery is not suitable for consumption, contact us by clicking HERE.

Upon delivery, a signature is required to complete the drop-off.

If your shipment experiences a delay and/or is delivered later than anticipated, Fulcher's Seafood is not to be held responsible for Product(s) rising above its freezing temperature.

While we make every effort to ensure the accuracy of all information, we reserve the right to limit
refunds and replacements and to make corrections if an error occurs. Please check all shipping
addresses carefully. As we are shipping perishable goods, we cannot guarantee the condition of the
package and/or product if the delivery service must reroute.


SECTION 4 - GENERAL CONDITIONS

We reserve the right to refuse Service to anyone for any reason at any time.
You understand that your content (not including credit card information), may be transferred
unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always
encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission by us.

Certain products may be available exclusively online through the website. These products may have
limited quantities and are limited time products that can be discontinued once their quantities are
depleted.

We have made every effort to display as accurately as possible the colors and images of our Products
that appear on our website to be as true as possible. We cannot guarantee that your computer
monitor's display of any color will be accurate. We reserve the right, but are not obligated, to limit the sales of our Products or Services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. cancel quantities purchased per person, per household or per order. These restrictions may include
orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

purchases made at our online store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Fulcher’s Seafood utilizes third party packaging materials. Please note that we are not liable for any
damages or injuries that may occur due to the utilization of packaging our Products using materials
purchased from third-parties.
